These Terms of Service (Terms) govern your use of the SecondQuote service (the Service) operated by Alystrx Pty Ltd (ACN 700 412 120) (we, us, our).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms are governed by the laws of the Australian Capital Territory, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.
SecondQuote is a decision-support tool. It analyses trade quotes submitted by users and returns an indicative assessment of quote completeness and pricing context based on heuristic rules and publicly available reference data.
The Service is designed to help homeowners make more informed decisions when evaluating quotes from tradespersons for residential work. It is not a substitute for professional advice.
You must read and understand this section before using the Service. The Service does not:
The Service returns indicative signals only. Any action you take based on the Service output is taken at your own risk.
You may use the Service if you are 15 years of age or older. By using the Service, you confirm that you meet this requirement.
The Service is intended for use by Australian residents evaluating quotes for residential trade work in Australia.
You may submit a quote and receive a result without creating an account. An email address and session identifier are collected to support optional account creation after the fact.
Account creation is prompted when you make a payment or elect to save your result. Accounts are created via email verification. We send a single-use code to the email address you provide. Entering the code (or using the fallback link in the same email) authenticates you and creates your account.
You do not set a password. Access to your account is controlled by access to your email inbox. You are responsible for maintaining the security of your email account.

If you submit a quote anonymously and subsequently create an account using the same email address, we will link your anonymous submission to your account. This allows your result and feedback history to be retained under your account.
You may request deletion of your account at any time by contacting privacy@secondquote.app. On deletion, your name, email, and directly identifying information will be removed. Analytical data that cannot identify you will be retained in de-identified form consistent with our Privacy Policy.

The Service provides one free quote analysis per user. Free access is tracked by session and account. Creating multiple accounts to obtain additional free checks is a breach of these Terms.
Additional access is available on a paid basis. Pricing tiers are displayed at the point of purchase. All prices are in Australian dollars and include GST where applicable.
Payments are processed by Stripe, Inc. By completing a payment, you agree to Stripe's terms of service. We do not store your payment card details.
Due to the nature of the Service (immediate digital delivery of an analysis result), we do not offer refunds once an analysis has been delivered, except where required by the Australian Consumer Law.
If you experience a technical failure that prevents delivery of your result, contact support@secondquote.app and we will assess your request.
Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law that cannot be excluded by agreement.
All intellectual property in the Service, including the analysis engine, rules, content, and software, is owned by Alystrx Pty Ltd or its licensors.
You retain ownership of the quote text you submit. By submitting quote text, you grant Alystrx Pty Ltd a non-exclusive, royalty-free licence to use that content for the purposes described in our Privacy Policy, including internal calibration and the development of aggregated, de-identified market intelligence.
You must not reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranty of any kind. We do not warrant that:
Assessment results reflect heuristic analysis based on reference data available at the time of the assessment. They do not reflect real-time market conditions.
To the maximum extent permitted by law, Alystrx Pty Ltd and its directors, employees, and contractors will not be liable for any loss or damage arising from your use of the Service, including:
Where our liability cannot be excluded by law, it is limited to the amount you paid for the specific access that gave rise to the claim, or the re-supply of the relevant service, at our election.
The Service uses Anthropic (AI processing), Supabase (database and authentication), Vercel (hosting), and Stripe (payments). We are not responsible for the availability or performance of these services beyond our reasonable control.
Our collection and use of personal information is governed by our Privacy Policy, available at secondquote.app/privacy. By using the Service, you consent to our Privacy Policy.
We may suspend or terminate your account and access to the Service at any time if we reasonably believe you have breached these Terms, without notice and without refund.
We may discontinue the Service at any time. Where we discontinue a paid subscription with remaining access, we will provide a pro-rata refund for unused paid access.
We may update these Terms from time to time. Material changes will be indicated by an updated effective date. Continued use of the Service after a change constitutes acceptance of the updated Terms.
